These Terms of Service govern your use of finalsitting.com and any commission, order, or service offered by Final Sitting LLC, a Delaware company in the United States. By using the website or placing an order, you agree to these terms.

The Final Sitting offers custom memorial portraits based on the details, reference materials, and selections you provide. Because the work is personalized, your commission may involve review, proofing, revision, production, and delivery stages.

Prices, product descriptions, tier features, and availability may change at any time. We reserve the right to correct errors, inaccuracies, or omissions and to refuse or cancel orders where necessary.

An order is not guaranteed until accepted and processed by us through the store and related systems.

You are responsible for the information, photos, and materials you submit. You represent that you have the right to share those materials and that they do not violate the rights of another person.

By submitting materials, you grant us the limited right to use, store, process, and reproduce them as necessary to review, prepare, revise, fulfill, and support your commission.

Our commissions include revisions during the proof stage as described on the site. Once you approve the final proof, your portrait may move into production and additional changes may no longer be possible.

Any turnaround times, shipping windows, or delivery estimates are good-faith estimates only. Delays may occur due to review cycles, shipping carriers, holidays, supply issues, or other events beyond our reasonable control.

Payments are processed through Shopify and its supported payment providers or other enabled methods. By placing an order, you agree to provide current, complete, and accurate payment information.

Because commissions are custom and personalized, cancellations, refunds, remakes, or other accommodations may depend on the stage of the order and the facts of the request. Any refund, return, or issue-resolution decisions are handled in accordance with the policies presented at checkout or otherwise communicated by us at the time of service.

All content on finalsitting.com, including site copy, branding, layout, images, graphics, and design elements, is owned by or licensed to Final Sitting LLC and may not be copied, reproduced, or used without permission except as allowed by law.

You may not use the site for unlawful purposes, to interfere with its operation, to attempt unauthorized access, or to submit false, harmful, or infringing materials.

The site and services are provided on an "as is" and "as available" basis to the fullest extent permitted by law. We do not guarantee uninterrupted, error-free, or completely secure access to the site at all times.

To the fullest extent permitted by law, Final Sitting LLC is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from your use of the site or purchase of our services.

You agree to indemnify and hold harmless Final Sitting LLC from claims, damages, liabilities, and expenses arising out of your breach of these terms or your submission of materials that violate the rights of another party.

These Terms of Service are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

We may update these Terms of Service from time to time. When we do, we will post the updated version on this page and revise the effective date.
